This guest performance contract is also\nalso known as a <strong>musical performance contract (sometimes also booking contract, live engagement contract, concert agreement).<\/strong>.<\/p>    <\/div>\n<\/div>\n<!-- \/module text --><!-- module text -->\n<div  class=\"module module-text tb_qktj196\" data-lazy=\"1\">\n        <div  class=\"tb_text_wrap\">\n        <h2>Why do I need a musical performance contract?<\/h2>    <\/div>\n<\/div>\n<!-- \/module text --><!-- module text -->\n<div  class=\"module module-text tb_up5a31\" data-lazy=\"1\">\n        <div  class=\"tb_text_wrap\">\n        <p>Music and artist performances are often the heart of an event and involve a great deal of effort in event planning. They appear in the program and (usually paying) guests come to see them. These commitments also block the artists' schedules and they often rehearse a special program just for them. Artists and clients are taking a considerable financial risk here. It goes without saying that both need assurance that, on the one hand, the band will show up for the performance (and not take a better job elsewhere in the meantime) and, on the other hand, that the customer will pay for the performance (with the promised fee) afterwards. The full calendars of venues nowadays also lead to bookings being made at least several months, but more likely several years, in advance. A lot can happen during this time. To ensure that both parties actually keep their promises in the end, they sign a contract. <strong>This creates security and commitment and serves as documentation of what both parties owe each other (and what they do not).<\/strong><\/p>    <\/div>\n<\/div>\n<!-- \/module text --><!-- module text -->\n<div  class=\"module module-text tb_m4gn196\" data-lazy=\"1\">\n        <div  class=\"tb_text_wrap\">\n        <h2>What does a guest performance contract cover?<\/h2>    <\/div>\n<\/div>\n<!-- \/module text --><!-- module text -->\n<div  class=\"module module-text tb_2o7a196\" data-lazy=\"1\">\n        <div  class=\"tb_text_wrap\">\n        <p>A guest performance contract <strong>regulates all agreements that are important to both parties in connection with the contract<\/strong>. As a minimum, this will include the <strong>performance venue, date and time, performance, set-up and tear-down times, the price, cancellation fee and\/or contractual penalties<\/strong> . For example, it would not be appropriate to include music promotion via flyers in a contract for a performance at a wedding, as would perhaps be usual for a concert. Nor should a contract for a concert performance include clauses on spontaneous prolongations. A general distinction could be made as to whether it is a <strong>cultural event<\/strong> (with entrance fee) with an artistic focus or a <strong>performance as part of a supporting program<\/strong> within a larger event. You can therefore also find sample contracts for numerous purposes on the Internet, e.g. for events, private parties, concerts, festivals and shows with multiple performances. <strong>Our sample contract is aimed in particular at performances for private parties or corporate events in Germany.<\/strong> It is therefore available only in German. Paper is patient and so when writing a guest performance contract, it is easy to be tempted to specify every single detail instead of limiting yourself to more general formulations. This can overwhelm organizers or customers to the point where a customer pulls out of the contract. For example, if you want to specify the band's catering, you may be less concerned with customer-oriented performance. In our opinion, a musician's contract should only cover as many points as there is potential for dispute. This means that things that are really important to you should be stipulated in the contract, according to the motto: <strong>as much as necessary, as little as possible.<\/strong>.\u00a0<\/p>\n<p><strong>Trap number two<\/strong> is <strong>forgetting a severability clause<\/strong> and thus unintentionally slipping into the nullity of an entire contract because a clause has become ineffective. There is a lot that can be contractually agreed in the event sector, including sometimes quite unusual requirements if the artists have special numbers. If it turns out that an agreement does not stand up in court (which would be bad enough, of course, because you should definitely make improvements here), the entire contract does not immediately become invalid if there is a severability clause that only removes the individual clause (e.g. the parking arrangements) from the contract and <strong>upholds the rest of the guest performance contract as far as possible.<\/strong><\/p>    <\/div>\n<\/div>\n<!-- \/module text --><!-- module text -->\n<div  class=\"module module-text tb_ye6b542\" data-lazy=\"1\">\n        <div  class=\"tb_text_wrap\">\n        <h2>Disclaimer<\/h2>    <\/div>\n<\/div>\n<!-- \/module text --><!-- module text -->\n<div  class=\"module module-text tb_lqzn542\" data-lazy=\"1\">\n        <div  class=\"tb_text_wrap\">\n        <p>The statements made here are based on over 20 years of experience in organizing concerts and events as a musician. Promotionma\u00dfnahmen. Dieser Gastspielvertrag ist auch <strong>als Musikervertrag (manchmal auch Bookingvertrag, Engagementvertrag, Konzertvertrag) bekannt<\/strong>.<\/p>\n<h2>Warum ben\u00f6tige ich einen Musikervertrag?<\/h2>\n<p>Musik- und K\u00fcnstlerperformances sind oftmals der Kern einer Veranstaltung und mit gro\u00dfem Aufwand in der Eventplanung verbunden. Sie stehen im Programmheft und wegen ihnen kommen (in der Regel zahlende) G\u00e4ste. Genauso blockieren diese Verpflichtungen den Terminkalender der K\u00fcnstler und diese proben nicht selten extra daf\u00fcr ein spezielles Programm. K\u00fcnstler und Kunden gehen hier ein nicht geringes finanzielles Risiko ein. Es versteht sich von selbst, dass beide eine Sicherheit ben\u00f6tigen, dass einerseits die Band zum Auftritt auch erscheint (und nicht zwischenzeitlich einen besseren Auftrag woanders wahrnimmt) und andererseits der Kunde diese Darbietung (mit der versprochenen Gage) auch anschlie\u00dfend bezahlt. Die vollen Kalender von Spielorten heutzutage f\u00fchren auch zu einer Buchung von mindestens mehreren Monaten, eher jedoch mehreren Jahren, im Voraus. In dieser Zeit kann nat\u00fcrlich viel passieren. Damit sich beide Parteien am Ende auch wirklich an ihre Zusagen halten, schlie\u00dfen sie einen Vertrag ab. <strong>Das schafft Sicherheit und Verbindlichkeit und dient als Dokumentation, was beide Vertragspartner sich gegenseitig schulden (und was nicht).<\/strong><\/p>\n<h2>Was regelt ein Gastspielvertrag?<\/h2>\n<p>Ein Gastspielvertrag <strong>regelt alle Absprachen, die den beiden Vertagsparteien im Zusammenhang mit dem Auftrag wichtig sind<\/strong>. Mindestens werden das <strong>Auftrittsort, Datum und Uhrzeit, Spiel-, Aufbau- und Abbauzeiten, der Preis, Ausfallhonorar bzw. Vertragsstrafen<\/strong> sein. Beispielsweise w\u00e4re es nicht angebracht, f\u00fcr einen Auftritt bei einer Hochzeit Musikpromotion \u00fcber Flyer vertraglich zu regeln, wie das vielleicht f\u00fcr ein Konzert \u00fcblich w\u00e4re. Genausowenig haben in einem Vertrag f\u00fcr eine Konzertdarbietung Klauseln zu Spontanverl\u00e4ngerungen zu suchen. Generell unterscheiden k\u00f6nnte man, ob es sich um eine <strong>Kulturveranstaltung<\/strong> (mit Eintritt) mit k\u00fcnstlerischem Fokus oder um einen <strong>Auftritt im Rahmenprogramm<\/strong> innerhalb einer gr\u00f6\u00dferen Veranstaltung handelt. Letztere k\u00f6nnen entweder Privatleute (f\u00fcr eine Hochzeit o.\u00e4.) oder beruflich agierende Vertragspartner (z.B. Agenturen bei Konzerten oder Event-Abteilungen bei Firmenevents usw.) sein.<\/p>\n<h2>Folgende Angaben sind f\u00fcr einen Musikervertrag notwendig<\/h2>\n<ul> <li>Name und Anschrift beider Vertragspartner oder deren Vertreter<\/li> <li>Name und Anschrift des Spielortes<\/li> <li>Lokalit\u00e4t innerhalb des Spielortes<\/li> <li>Art der Veranstaltung (und ggf. Parkpl\u00e4tze, Leihinstrumente)<\/li> <li>Technical Rider als Anlage (siehe <a href=\"https:\/\/www.pocketjazztrio.com\/technical-rider\/\" target=\"_blank\" rel=\"noopener\">Infos und Vorlage zum Technical Rider<\/a>)<\/li> <li>Salvatorische Klausel<\/li> <li>Gerichtsstand<\/li> <li>Datum, Ort und Unterschriften der beiden Vertragspartner (oder deren Vertretungsberechtigten)<\/li> <\/ul>\n<h2>Welche Fehler sollte ich im Vertrag besser vermeiden?<\/h2>\n<p>Insbesondere zwei Fallen k\u00f6nnen in einem Vertrag stellen:<\/p> <p><strong>Falle Nummer eins<\/strong> ist die <strong>Verf\u00fchrung, zu viel regeln zu wollen<\/strong>. Papier ist geduldig und so verleitet das Verfassen eines Gastspielvertrags schnell dazu, jede Einzelheit bis ins Detail festzulegen statt sich auf allgemeinere Formulierungen zu beschr\u00e4nken. Das kann Veranstalter oder Kunden auch schon mal \u00fcberfordern bis zu dem Punkt, wo sich ein Kunde aus dem Vertrag zur\u00fcckzieht. Wer beispielsweise die Verpflegung der Band genau festlegen m\u00f6chte, dem geht es vielleicht weniger um die kundenorientierte Performance. Ein Musikervertrag sollte unserer Ansicht nach nur so viel regeln, wie es auch Auseinandersetzungspotential gibt. Das bedeutet, Dinge die einem wirklich wichtig sind, sollten vertraglich festgelegt werden, nach dem Motto: <strong>so viel wie n\u00f6tig, so wenig wie m\u00f6glich<\/strong>.\u00a0<\/p> <p><strong>Falle Nummer zwei<\/strong> ist das <strong>Vergessen einer Salvatorischen Klausel<\/strong> und damit das unbeabsichtigte Hineinrutschen in die Nichtigkeit eines gesamten Vertrags, weil eine Klausel unwirksam geworden ist. Man kann im Eventbereich vertraglich eine ganze Menge vereinbaren, auch manchmal recht ungew\u00f6hnliche Anforderungen, wenn es spezielle Nummern der K\u00fcnstler sind. Sollte es sich erweisen, dass eine Vereinbarung vor Gericht nicht standhaft ist(, was nat\u00fcrlich schon schlimm genug w\u00e4re, weil man auf hier jeden Fall nachbessern sollte,) wird der gesamte Vertrag nicht gleich unwirksam, wenn eine Salvatorische Klausel vorhanden ist, welche nur die einzelne Klausel (z.B. die Parkplatzregelung) aus dem Vertrag herausnimmt und den <strong>Rest des Gastspielvertrages soweit wie m\u00f6glich aufrecht erh\u00e4lt.<\/strong><\/p>\n<h2>Haftungsausschluss<\/h2>\n<p>Die hier gemachten \u00c4u\u00dferungen gehen auf \u00fcber 20 Jahre Erfahrung in der Durchf\u00fchrung von Konzerten und Events als Musiker zur\u00fcck.
